1. Acceptance of Terms

By accessing the B3TR BEACH website, connecting your wallet, or participating in events listed on our platform, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Platform Nature & User Responsibility

2.1 Tool Provider Status: B3TR Beach operates solely as a technology platform that connects users with environmental cleanup opportunities. B3TR Beach does not organize, supervise, or control the physical cleanup events created by users on the Platform. We are a tool provider, not an event host.

2.2 Compliance with Local Laws (No Trespassing):

You agree that you are solely responsible for:

  • Obtaining all necessary permits, permissions, and authorizations for any cleanup location.
  • Ensuring you are not trespassing on private or restricted government property.
  • Complying with all local, state, and federal laws regarding waste disposal and hazardous materials.

B3TR Beach explicitly disclaims all liability for events organized in violation of local laws or on private property without permission.

3. Assumption of Risk & Liability Waiver

IMPORTANT WAIVER:

3.1 Hazardous Activity: You acknowledge that participation in beach and ocean cleanup activities involves inherent risks and physical exertion. These risks include, but are not limited to: sharp objects (glass, metal), hazardous waste, slippery or uneven terrain, weather conditions, and encounters with wildlife.

3.2 Waiver: BY USING THIS APP TO ORGANIZE OR PARTICIPATE IN A CLEANUP, YOU VOLUNTARILY ASSUME ALL RISKS associated with the activity. You agree to release, waive, and hold harmless B3TR BEACH, its officers, directors, employees, and agents from any and all claims, liabilities, injuries, damages, or losses arising from your participation.

4. Indemnification

You agree to indemnify, defend, and hold harmless B3TR Beach from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with: (a) your violation of these Terms; (b) your violation of any third-party right, including without limitation any intellectual property, property, or privacy right; or (c) any claim that your organized event caused damage to a third party.

5. Digital Rewards (Impact to Earn)

B3TR tokens and XP points are utility rewards used within our ecosystem to incentivize environmental action.

  • No Financial Advice: We do not guarantee the monetary value of B3TR tokens. They are intended for community engagement and store redemption.
  • Wallet Security: You are responsible for the security of your own crypto wallet. We cannot recover funds or rewards sent to incorrect addresses or lost due to compromised private keys.

6. Code of Conduct

All community members and event participants agree to:

  • Treat fellow volunteers, staff, and the environment with respect.
  • Follow all safety instructions provided by Event Organizers.
  • Dispose of collected waste in designated areas only.
  • Refrain from harassment, discrimination, or violent behavior.

We reserve the right to ban any individual from events and digital platforms for violating this code.

7. Store & Merchandise

Merchandise availability is subject to change. B3TR BEACH reserves the right to refuse service or cancel orders at our discretion. Returns are handled on a case-by-case basis as detailed in our shipping confirmation emails.

8. Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which B3TR BEACH operates, without regard to its conflict of law provisions.
